Perspective

General information

This website uses Mobile Funnel (hereinafter: Funnel), operated by Perspective Software GmbH (hereinafter: Perspective), a company based in Germany, which offers software for creating and operating Mobile Funnel (https://perspective.co/impressum). The data entered when using Mobile Funnel is transmitted via SSL encryption and stored in a database. Curia Consulting GmbH, Oststraße 55, 40211 Düsseldorf is responsible for this data within the meaning of Art. 24 GDPR. Perspective is merely the operator of the software and, in this context, a processor under Art. 28 GDPR. The basis for processing by Perspective is a data processing agreement between Curia Consulting GmbH and Perspective. In addition, Perspective Software GmbH processes further data in order to provide its services, in particular for operating Mobile Funnel, some of which may also be personal data. This is explained in more detail below.

Access logs (“server logs”)

Every time the funnel is accessed, general log data, known as server logs, is automatically collected. This data is generally pseudonymised and therefore does not allow any conclusions to be drawn about a specific individual. Without this data, it would in some cases be technically impossible to deliver and display the software's content. In addition, the processing of this data is essential for security reasons, in particular for access, input, transmission and storage control. Furthermore, the anonymous information may be used for statistical purposes as well as for optimising the offering and the technology. In addition, the log files may be reviewed and analysed retrospectively if there is suspicion of unlawful use of the software. The legal basis for this can be found in Section 15 (1) of the German Telemedia Act (TMG) as well as Art. 6(1)(f) GDPR. Generally collected data includes the domain name of the website, the web browser and browser version, the operating system, and the timestamp of access to the software. The user's IP address is not stored. However, the user is assigned a so-called session ID. The scope of this logging does not exceed the usual scope of any other website on the internet. These access logs are stored for up to 7 days. There is no right of objection.

Collection of User Behaviour Data

In general, data such as the domain name of the website, the web browser and web browser version, the operating system, the user's session ID, and the timestamp of access to the software are collected. All data entered by the user when using the funnels (e.g. answering form fields; use of interactive components) is assigned to the user by means of a session ID and made available to the operator of this website. It is the responsibility of the operator of this website to delete, store and further process this personal data in accordance with current legislation.

Use of Cookies

So-called cookies are used in the funnel. These are small text files that are stored on the device you use to access this funnel. The cookies used serve to ensure security when visiting a website (“strictly necessary”), to implement certain functionalities such as default language settings (“functional”), and to improve the user experience or performance on the website (“performance”). Within the funnel, strictly necessary, functional and performance cookies are used, in particular to implement certain default settings such as language, to store given answers even with a poor internet connection, or to analyse the performance of a funnel and the channel used by a user to reach this funnel. The operator of this website has the option to decide individually for each funnel used which choices regarding the use of cookies are given to the user. It is the responsibility of the website operator to use cookies in accordance with applicable legal restrictions. If the website operator uses extensions from external companies within the funnel, it is the responsibility of the website operator to inform the user about this.

Data Subject Rights

Insofar as personal data is processed by Perspective Software GmbH as the controller, you, as the data subject, have certain rights under Chapter III of the EU General Data Protection Regulation (GDPR), depending on the legal basis and purpose of the processing, including in particular the right to information (Art. 15 GDPR), the right to rectification (Art. 16 GDPR), the right to erasure (Art. 17 GDPR), the right to restriction of processing (Art. 18 GDPR), the right to data portability (Art. 20 GDPR), and the right to object (Art. 21 GDPR). Insofar as the processing of personal data is based on your consent, you have the right under Art. 7(3) GDPR to withdraw this data protection consent. Final provisions

Perspective reserves the right to amend this privacy policy at any time in order to ensure that it always complies with current legal requirements, or to implement changes to services in the privacy policy, e.g. when introducing new services. The new privacy policy will then apply to any renewed visit to the funnel.

Zapier

We use the automation software Zapier for our website. The service provider is the American company Zapier Inc., 548 Market Street 6241, San Francisco, CA94104, USA.

Zapier also processes your data in the USA, among other places. We would like to point out that, in the opinion of the European Court of Justice, there is currently no adequate level of protection for data transfers to the USA. This may be associated with various risks to the lawfulness and security of data processing.

As a basis for data processing involving recipients based in third countries (outside the European Union, Iceland, Liechtenstein, Norway, i.e. in particular in the USA) or a transfer of data there, Zapier uses what are known as standard contractual clauses (= Art. 46 (2) and (3) GDPR). Standard contractual clauses (SCCs) are template agreements provided by the EU Commission and are intended to ensure that your data continues to meet European data protection standards even when it is transferred to and stored in third countries (such as the USA, for example).

Through these clauses, Zapier commits to maintaining the European data protection standard when processing your relevant data, even if the data is stored, processed and managed in the USA. 7. Newsletter

Newsletter data

If you would like to subscribe to the newsletter offered on the website, we require an email address from you, as well as information that allows us to verify that you are the holder of the email address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. We use this data exclusively to send the requested information and do not pass it on to third parties.

The data entered into the newsletter sign-up form is processed solely on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter. The lawfulness of the data processing carried out before the withdrawal remains unaffected.

The data you provide to us for the purpose of receiving the newsletter is stored by us or the newsletter service provider until you unsubscribe from the newsletter, and is deleted from the newsletter distribution list after unsubscribing or once the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion, based on our legitimate interest under Art. 6 (1)(f) GDPR.

Data that we have stored for other purposes remains unaffected by this.

After you unsubscribe from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is used only for this purpose and is not combined with other data. This serves both your interests and our interest in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage in the blacklist is not time-limited. You may object to the storage if your interests outweigh our legitimate interest

Managing contacts and sending messages
This type of service enables the management of a database of e-mail contacts, phone numbers or any other contact information in order to communicate with the user.
The services may also collect data on the date and time a message was read by the user, as well as on when the user interacts with incoming messages, for example by clicking on links contained within them.

This website embeds videos from the YouTube website. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our web pages on which YouTube is embedded, a connection is established to YouTube's servers. This tells the YouTube server which of our pages you have visited.

Furthermore, YouTube may store various cookies on your device or use comparable technologies for recognition purposes (e.g. device fingerprinting). 9. eCommerce and payment providers

Processing customer and contract data

We collect, process and use personal customer and contract data for the purpose of establishing, structuring and amending our contractual relationships. We only collect, process and use personal data relating to the use of this website (usage data) to the extent necessary to enable the user to use the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.

The customer data collected is deleted after completion of the order or termination of the business relationship and expiry of any applicable statutory retention periods. Statutory retention periods remain unaffected.
 

10. Use of Chatbots

We use Typebot to provide a chatbot on the website. The chatbot processes meta/communication data (e.g. device information, IP addresses) and messages exchanged between the bot and the user in order to answer questions from website visitors. The bot is hosted locally on servers provided by Digital Ocean. The data is processed in the USA.

The hosting provider is Digitalocean LLC, 101 Avenue of the Americas 10th Floor, New York, NY 10013, USA. OpenAI (ChatGPT) is used as the service provider for answering questions. The provider is OpenAI Ireland Ltd., 1st Floor, The Liffey Trust Centre, 117-126 Sheriff Street Upper, Dublin 1, D01 YC43, Ireland.

The legal basis for the processing is Art. 6 (1) sentence 1 (f) GDPR. We have a legitimate interest in offering website visitors a simple way to get support and have their questions answered.

The transfer of personal data to a country outside the EEA is based on an adequacy decision. The security of the data transferred to the third country (i.e. a country outside the EEA) is ensured, as the EU Commission has decided, within the framework of an adequacy decision pursuant to Art. 45(3) GDPR, that the third country guarantees an adequate level of protection.

11. Tracify

We use the web analytics service Tracify on our website, or on parts of our website, to record how our website is used by its visitors and to evaluate and optimise the effectiveness of our advertising/marketing measures. Tracify is a web analytics service provided by Tracify GmbH in Munich, Germany. Tracify GmbH acts for us as a processor on the basis of a data processing agreement in accordance with Art. 28 GDPR.

Tracify enables an analysis of website usage and the customer journey without storing cookies or other information on the user's device, but solely on the basis of browser and device information, such as the user's IP address, the configuration of the respective user agent (User Agent String), usage data, order information, contact details, screen resolution, installed fonts and plugins, and the processor of the respective device.

The information transmitted to Tracify is fully and irreversibly anonymised immediately after transmission, so that any connection to a person is ruled out. Only the anonymised, aggregated information is analysed.

Data processing when using Tracify takes place entirely within Germany; no data is transferred to unsafe third countries without an adequate level of data protection.

The legal basis for the use of Tracify is our legitimate interest pursuant to Art. 6(1)(f) GDPR in the needs-based design of the website and in the evaluation and optimisation of our marketing measures.
